The Martha Company continues to explore how to solve its problems with providing sufficient water pressure to fight fires and how to mitigate for serious impacts to special status species.
Marin Municipal Water District (MMWD) in November 2014 rejected the Martha proposed water tank placement at 590 feet elevation as being a liability risk and a violation of its view ordinance.
Also Marin County continues to reject Martha’s proposed off-site mitigation for special status species. Marin County ordinances require Martha to prove it is impossible to mitigate onsite for these impacts.
On July 28, 2016 a Federal Judge ruled that Martha must submit new development plans to address these two significant environmental issues plus any other issues raised by the Marin County Supervisors in their March 2014 meeting. Marin County must process those plans. Martha and the Marin County are scheduled to return to Federal Court for an update on January 30, 2017.
The Martha Company has recently placed No Trespassing signs and new fencing at all the trails to their property, ending years of access.
